Terms and Conditions

1. Who we are

Amainu ("we," "us," "our") operates an online marketplace that allows Artisans to create a profile and list up to 6 items for sale, and allows Buyers to browse, inquire about, and purchase these items.

2. Eligibility

You must be at least 16 years old to create an account. By using our platform, you confirm that the information you provide is accurate and that you have the legal capacity to enter into these Terms.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must provide accurate, current information when creating your profile.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Artisan listings

• Artisans may list a maximum of 6 items at a time.
• Artisans are solely responsible for the accuracy of their listings, including descriptions, pricing, images, and availability.
• Artisans retain ownership of the intellectual property in their photos, descriptions, and designs, but grant us a non-exclusive license to display this content on our platform for the purpose of operating the marketplace.
• Items must be genuine, handmade, or created/curated by the Artisan. Counterfeit, mass-produced, or misrepresented items are prohibited.
• We reserve the right to remove any listing that violates these Terms or applicable law.

5. Purchases and inquiries

• Buyers may contact Artisans directly through inquiry forms or, where enabled, complete a purchase through the platform's checkout.
• All payments are processed through our third-party payment provider (e.g. Stripe). We do not store your full payment card details.
• Transactions occur directly between the Buyer and the Artisan. Amainu is not a party to the sale and does not guarantee the quality, safety, legality, or accuracy of any listed item.
• Shipping, returns, and refunds are the responsibility of the Artisan unless otherwise stated on their profile or item listing.

6. Fees

We do not currently charge fees for listings or transactions.

7. Prohibited conduct

You agree not to:

• Upload false, misleading, or infringing content
• List prohibited, illegal, or counterfeit items
• Harass, defraud, or mislead other users
• Attempt to circumvent platform fees or payment systems
• Use the platform for any unlawful purpose

8. Intellectual property

All platform branding, design, and functionality (excluding user-uploaded content) is owned by Amainu and may not be copied or reused without permission.

9. Disclaimers

Our platform is provided "as is." We do not guarantee that the platform will be uninterrupted, error-free, or secure. We are not responsible for disputes between Buyers and Artisans, the quality of items sold, or any loss resulting from transactions made through the platform.

10. Limitation of liability

To the maximum extent permitted by law, Amainu is not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to disputes between Buyers and Artisans.

11. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. You may also close your account at any time.

12. Changes to these terms

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of The Netherlands, without regard to conflict of law principles.
